Scope of application
- The General Terms and Conditions apply to all contracts of Silicon Surfer and all pre-contractual relations with Silicon Surfer. All services, information, advice and installations are included in the scope of application of the General Terms and Conditions. These General Terms and Conditions also apply to all future contracts and business relations, even if they are not explicitly included again. The general terms and conditions of the customer shall not become part of the contract even if the customer refers to his own general terms and conditions within the scope of initiating the business or placing the order. An explicit objection by Silicon Surfer is not necessary.
Prices
- All prices are final prices and include the legal sales tax. In all further offers, order confirmations and invoices the value added tax is shown separately.
Terms of payment
- The payment option offered for the "Standard" and "WaveFont" packages is: PayPal (payment service provider). Captions are created only after we have been informed by the payment service provider that the payment has been received.
- For the "Customize" package we send an appropriate offer after indication of the individual desires. After the written confirmation by the customer we start with the implementation. The offered payment options for the package "Customize" are: By invoice or PayPal. The payment period for the "Customize" package is 14 days after receipt of the invoice by the customer.
- In the case of public institutions, payment by invoice is possible.
- In case of default of payment by the customer, Silicon Surfer is entitled to withhold services and deliveries to a reasonable extent.
Terms of delivery and service
- Our delivery time for the packages "Standard" and "WaveFont" can take up to 5 days in exceptional cases. However, the delivery usually takes place within 2-3 working days after payment. For the package "Customize" the delivery time depends on the desired customizations and is communicated to the customer in the offer.
- The customer is obliged to accept the delivery in due time.
- The customer shall also support Silicon Surfer in the performance of the services/deliveries within the scope of his duties to cooperate. The customer has to answer questions regarding the captioning.
- After completion of the captioned video we will send an email with a link for the download. The download link is valid for 14 days from the date the email was sent. Usually, the customer will find the email in the mailbox of the email address provided by the customer during the ordering process.
- We will inform our customers immediately as soon as we know about a non-availability of services or products at Silicon Surfer. Liability for delayed, defective or omitted services/deliveries in such a case is excluded, unless Silicon Surfer is responsible for it.
- Silicon Surfer is entitled to have its services provided temporarily or permanently, in whole or in part by third parties.
- For the smooth assurance of our service we make use of services such as Leadpages, JotForm, Dropox, WordPress, Google Cloud Services, and PayPal.
- We deliver the highest quality for our customers. We follow our captioning standards, which are based on successful subtitle standards (e.g. subtitle standards of BBC). In the case of justified complaints, a reworking of the video is planned.
In the "Standard" and "WaveFont" packages, only short videos with a maximum length of 20 minutes are processed. In the "Customize" package, longer videos can also be processed.
- In the "Standard" and "WaveFont" packages, captions are created exclusively for short videos with German or English audio track. In the "Customize" package, videos with an audio track in other languages can also be processed.
- In the package "Standard" we usually use the font "Open Sans" and in the package "WaveFont" we use the font "WaveFont" which Silicon Surfer developed particularly for this purpose.
- The font sizes of the captions in the "Standard" and "WaveFont" packages are usually 12pt. Minor deviations are not excluded.
- The font color of the captions in the "Standard" and "WaveFont" packages is usually white.
- The background color of the captions in the "Standard" and "WaveFont" packages is usually black or gray.
- The captions consist of a maximum of two lines and are centered as a text block at the bottom of the screen. Usually, the captions are displayed in one line.
- In the "Customize" package, parameters for captioning can be defined by the customer.
Confidentiality, privacy
- Silicon Surfer is authorized to process entrusted personal data or to have them processed by third parties within the scope of the intended purpose of the customer. For the duration of the contractual relationship, the contractor shall store the customer's data electronically. The contractor undertakes to comply with all data protection regulations applicable in the Federal Republic of Germany.
Severability clause
- The invalidity of a provision of these General Terms and Conditions shall not affect the validity of the other provisions. The contracting parties shall endeavour to agree on another comparable condition instead of the ineffective condition, which comes as close as possible to the technical, economic and financial aspects of the actual provision.
